Creating a Family Will

I have been reading Frugal Coupon Living since it first went live; even before it took off from little ‘ol Tallahassee to go national! I know that you, the readers, are busy women trying to juggle life, often with small children, perhaps with a job outside of the home, and the demands of trying to live within your means in a challenging economic time. To put it bluntly, I know that your time is precious and you don’t want to waste it reading some guest post that won’t benefit you or your family directly. But trust me when I say that spending a few minutes considering the future of your family is not wasted time.
So here is what you need to know about making a Will for your family:
1. You need a Will to designate who gets the kids.
If you have children they have to have a guardian if you or your spouse were to die. The state has a plan, but frequently it does not match the parent’s wishes. Many times, the people who the state would give the children to are NOT the ones you and your spouse would choose.
2. If you don’t have Life Insurance, you need it.
If something were to happen to you, you need life insurance in order to care for your children; not just to cover your debts.
3. You need to formalize who gets to make your medical decisions if you can’t.
The Florida Terry Shivo case made the issue of Living Wills mainstream, but did you know that you need a formal designation of Health Care surrogate for even your spouse to find out information about your health if you are incapacitated? New laws make it almost impossible for a family member to find out what medical conditions you may be facing; much less make any decisions for you if you can’t. A Designation of Health Care Surrogate needs to be a part of your estate planning.
4. Even if you don’t “have much” you may still need a trust for your children.
When I thought about the possibility of my children inheriting the sum of my estate when they are 18 years old, I thought better of it. Seems awfully young now that I am older. If you want life insurance proceeds to be kept for them until they are a little more mature, then you need a simple trust.
5. Estate Plans don’t have to cost a lot.
While you certainly don’t want to trust your Will to an online service like LegalZoom, you can expect to find reasonable flat rate wills with real attorneys to answer your calls.
Of course there are many more things you may want to know about making an Estate Plan. But here is the main point, if you have children; you owe it to them to protect their future. Planning for your family, in the event you can’t be here to take care of them, won’t make your death more likely, it will only provide the security that they deserve.
